Kudotrade keeps retail client funds in separate bank accounts, distinct from its own operational funds.
Retail clients receive additional safeguards compared to wholesale clients, including negative balance protection. You can request confirmation of your classification as either a retail or wholesale client at any time. If you choose to be classified as a retail client permanently, your status will not be subject to future reclassification.
In the event of Kudotrade becoming insolvent, merging with another company, or ceasing some or all of its operations, retail client funds will be distributed as follows:
1. Funds in segregated bank accounts are held in trust for the rightful beneficiaries and are distributed in the following order:
2. Any funds mistakenly deposited into the account are corrected first.
3. Next, payments are made to each individual entitled to receive money from the account.
4. If the available funds are insufficient to cover all entitlements, they will be distributed proportionally among eligible recipients.
5. Any remaining balance after these distributions will be retained by Kudotrade.
If client funds have been invested by Kudotrade, those investments are also held in trust for individual clients and will be allocated accordingly to those entitled to them.
